With more mobile phones in Britain than people the pressure is on for mobile phone operators to provide comprehensive coverage and landowners must be sure that their interests are not being abused.
According to Kenneth Munn of property specialist Strutt & Parker, there have been instances where some phone operators have erected masts without gaining permission from the landowner. He says, “some landowners have found masts have been erected on their land with no obvious features identifying who owns them. W have acted on behalf of a local authority who had two masts erected without any written or verbal communication with our clients.”
“we are also aware of some operators carrying out upgrades of equipment without seeking permission from landlords. These upgrades are not normally allowed under the terms of their agreement although in some instances it is bona fide.”
Another area of caution according to Mr Munn is that operators are requesting consents at a sum significantly blow the market rate.
Mr Munn urges all landowners to monitor the payments they are receiving and to be fully aware of the rights granted to their telecom tenants. If there are any areas of concern professional advice should be sought.
