The site is located in Witham, Essex. Witham is located approximately 5 miles south west of Braintree, 8 miles north east of Chelmsford and 35 miles north east of London. Witham is accessed via the A12 which runs north to south and the Cressing Road (B1080) which runs east to west. The site benefits from an outline planning permission dated 26th July 2013 (Ref: 12/01071/OUT) for a mixed use development comprising a commercial area for employment, neighborhood centers, community facilities including food retail, non-food retail, a pub/restaurant, Class B1 office, retail warehousing, other uses within Classes A1 to A5, childrens day nursery, health center, sports facilities, residential dwellings, open space, landscaping and ancillary infrastructure.
The Section 106 requires that prior to the 150th occupation of the residential dwellings, (taking account of the entire Maltings Lane / Gershwin Park Development), the commercial units within the red line will need to be delivered. It should be noted that the 151st dwelling will be the first dwelling delivered within the red line to be sold. It is the intention that the commercial units will be handed back to the vendors by the developer built to the specification required (shell & core) as detailed within the Data Room.
The Section 106 Agreement does require 30% affordable housing.
