Location

The site is located in Witham, Essex. Witham is located approximately 5 miles south west of Braintree, 8 miles north east of Chelmsford and 35 miles north east of London. Witham is accessed via the A12 which runs north to south and the Cressing Road (B1080) which runs east to west. The A12 runs along the eastern boundary of the town and provides access to the East of England, London, and the M25. Witham Town train station offers a regular service to central London in 45 minutes and is situated approximately 1.7 miles from the site.

Witham town centre lies approximately 1.1 miles to the north east of the site and supports a variety of shops and bars, two supermarkets, two public halls and The Grove shopping centre.

Description

The site is of irregular shape and measures approximately 4.36 acres (1.76 Ha). It is situated to the southern edge of Witham, within a new mixed use estate. The subject site comprises a parcel of scrub land and is one of the last remaining plots which form the Maltings Lane / Gershwin Park Development.

The site is bound to the south west by Gershwin Boulevard, a children’s nursery and office buildings, along with a further plot for future B1 use. To the north east Aldi food store and future community uses form the oundary. Owers Road comprises the eastern boundary. Vehicular access is gained from both Owers Road and Gershwin Boulevard.

Planning

The site is situated within the local authority of Braintree District Council. The site benefits from an outline planning permission dated 26th July 2013 (Ref: 12/01071/OUT) for “a mixed use development comprising a commercial area for employment, neighborhood centers, community facilities including food retail, non-food retail, a pub/restaurant, Class B1 office, retail warehousing, other uses within Classes A1 to A5, children’s day nursery, health center, sports facilities, residential dwellings, open space, landscaping and ancillary infrastructure”.

The Section 106 requires that prior to the 150th occupation of the residential dwellings, (taking account of the entire Maltings Lane / Gershwin Park Development), the commercial units within the red line will need to be delivered. It should be noted that the 151st dwelling will be the first dwelling delivered within the red line to be sold. It is the intention that the commercial units will be handed back to the vendors by the developer built to the specification required (shell & core) as detailed within the Data Room.

The Section 106 Agreement does require 30% affordable housing.
